How to Get an Employment Equity Compliance Certificate

In a world where diversity and fair representation have become central to business ethics, compliance with employment equity laws is no longer optional—it’s legal and a necessity. Companies are required by the Employment Equity Act (EEA) to promote equal opportunity and eliminate unfair discrimination in the workplace. One of the key components of this compliance is obtaining an Employment Equity Compliance Certificate, which serves as proof that an employer meets the legal requirements set out by the Department of Employment and Labour.

Whether you’re a business owner or HR professional, understanding how to obtain this certificate is essential for maintaining credibility, securing government contracts, and demonstrating a genuine commitment to workplace equality.

What Is an Employment Equity Compliance Certificate?

An Employment Equity Compliance Certificate is an official document issued by the Department of Labour. It confirms that an employer has met the requirements of the Employment Equity Act, which aims to promote fairness and transformation in the workplace.

The certificate is valid for 12 months and is often required when applying for government tenders, renewing BBBEE (Broad-Based Black Economic Empowerment) certificates, or engaging in contracts with public sector entities. Without it, a company may be disqualified from certain business opportunities.

Who Needs to Apply?

Any non-designated employer must apply for this certificate. A none-designated employer is defined as:

  • A company with less than 50 employees and not bound by a collective agreement.

Businesses that fall under these categories are not legally required to comply but are encouraged to adopt equitable employment practices voluntarily.

Once all requirements are met, employers can apply for their Employment Equity Compliance Certificate through the Department of Employment and Labour’s online portal. The system will automatically verify your compliance history and generate a certificate if all conditions are met.

Select proceed and you will be able to download the certificate.

Once issued, display the certificate prominently at your workplace. Continue monitoring progress toward equity goals and maintain your compliance to ensure smooth renewal the following year.

Why Compliance Matters

Beyond legal compliance, obtaining this certificate demonstrates that your company values diversity, fairness, and inclusion. It boosts your reputation, enhances staff morale, and positions your business as a socially responsible organisation. Moreover, it provides access to lucrative government tenders and improves your BBBEE score, contributing to long term sustainability.
